PERMIT AND APPROVAL REQUIREMENTS

• Setbacks: Town of Huntersville’s Planning FAQ states that most fences do not require a setback.
• Easements: Town of Huntersville’s Planning FAQ states that Town staff does not recommend placing a fence in easements.
• Utility Safety: North Carolina’s Underground Utility Safety and Damage Prevention Act requires the person responsible for excavation or demolition to provide notice to the Notification Center (NC 811) before digging. Notice must be provided not less than three (3) full working days before the proposed commencement date of the excavation or demolition. Notice expires 28 calendar days after the date notice was given.
FENCE HEIGHT AND VISIBILITY RULES
• Front Yard Height (Residential): In the established front yard of a building, a fence or wall must be a minimum of 2 feet in height and a maximum of 5 feet in height. Decorative caps or spires that extend above the highest horizontal member are not included in the measurement of height.
• Side or Rear Yard Abutting a Street or Alley (Residential): In an established rear or side yard that abuts a street or alley, a fence or wall may not exceed 6 feet in height unless placed 15 or more feet inside the property boundary.
• Side or Rear Yard Not Abutting a Street or Alley (Residential): In an established rear or side yard that does not abut a street or alley, a fence or wall may not exceed 8 feet in height.
• Visibility and Sight Triangles: The municipal code does not specify a fence visibility or sight-triangle standard in the sources compiled for this page.
MATERIAL AND CONSTRUCTION LIMITS
• Chain Link, Welded Wire, and Similar Materials (Front Yards): Where chain link, welded wire, or similar fencing materials are used, the zoning ordinance states these materials must be placed on the interior side of a masonry wall, solid wood fence, or decorative wood or vinyl fence that is equal to or greater in height than the secure fencing and demonstrates effective screening capability.
• Chain Link and Similar Materials (Side or Rear Yards Abutting a Street or Alley): Within the first 15 feet of an established rear or side yard that abuts a street or alley, fences of chain link or similar material are permitted only if screened on the exterior side by evergreen shrubs planted no farther apart than 6 feet on center, with a minimum height of 3 feet at installation, or if obscured from view by the screening method described in the front yard materials standard.
• Swimming Pool Enclosures: For swimming pools on single-family residential sites, the zoning ordinance states the pool area must be completely enclosed by a fence or wall no less than 4 feet and no more than 8 feet in height (measured on the side facing away from the swimming pool). Gates providing access into the pool area must open outward away from the pool and must be self-closing and have a self-latching device.
• Other Material Limits: The municipal code does not specify additional prohibited fence materials or general construction requirements for typical single-family residential perimeter fences in the sources compiled for this page.
PRIVATE RESTRICTIONS
Private restrictions, including subdivision covenants and HOA rules, are separate from Town of Huntersville requirements and may be more restrictive than municipal rules.
