FENCE RULES – GASTONIA (CITY), NORTH CAROLINA

OVERVIEW

Residential fences are permitted on private property within City of Gastonia, subject to local regulations.

Within the City of Gastonia, residential fence rules are primarily set by the City of Gastonia Unified Development Ordinance (UDO), with additional standards in the City’s Code of Ordinances for street rights-of-way and intersection visibility.

This page focuses on typical single-family residential fencing. If the jurisdiction’s adopted materials do not state a specific limit or requirement, this page notes that the code does not specify one.

Compiled From City of Gastonia Unified Development Ordinance, City of Gastonia Code of Ordinances, City of Gastonia Planning materials, City of Gastonia Permits and Inspections materials, City of Gastonia Local Historic District materials, and NC OSFM building code administrative provisions as of February 2026.

GOVERNANCE

City of Gastonia fence rules are administered through City of Gastonia Planning Department (zoning and UDO administration) and related City development services functions.

The primary residential fence standards are published in the City of Gastonia Unified Development Ordinance (UDO), including the “Fences or Walls Permitted” provisions and the “Sight Distance Triangles” provisions.

The City of Gastonia Code of Ordinances includes separate requirements affecting fences in street rights-of-way and at street intersections.

For construction building permits, City of Gastonia materials state that construction permits are issued by Gaston County Permitting, with City-issued zoning approvals used as part of that construction-permit process when applicable.

PERMIT AND APPROVAL REQUIREMENTS

Building Permit (Statewide Baseline): A Building Permit is not required for standard residential fences 7 feet in height or lower, per the locally adopted residential building code, as stated in the sources compiled for this page.

Zoning Permit: The City of Gastonia UDO states that a zoning permit is not required for fences, except where the UDO’s historic overlay provisions require a separate approval.

Local Historic Districts (COA): For properties within a City of Gastonia local historic district, a Certificate of Appropriateness (COA) is required before exterior work begins, and City materials list fencing as a category of “minor work” subject to the COA process.

FENCE PLACEMENT RULES

The ordinance does not state a setback requirement for standard residential fences from property lines; however, fences must be located entirely on the owner’s property and must not encroach into rights-of-way or easements.

Street Right-of-Way: The City of Gastonia Code of Ordinances prohibits placing or maintaining encroachments in a street right-of-way, and lists fences as an example of an encroachment.

Drainage and Utility Easements: The UDO prohibits fences or walls within a general drainage or utility easement when the fence or wall would block or materially impede the flow of stormwater runoff.

Corner Lots and Intersections: Fences on corner lots are subject to the City’s sight distance triangle visibility standards, which limit obstructions in defined areas near street intersections.

Utility Safety: North Carolina’s Underground Utility Safety and Damage Prevention Act requires the person responsible for excavation or demolition to provide notice to the Notification Center (NC 811) before digging. Notice must be provided not less than three (3) full working days before the proposed commencement date of the excavation or demolition. Notice expires 28 calendar days after the date notice was given.

FENCE HEIGHT AND VISIBILITY RULES

Front Yard Setback Height: In residential districts, fences or walls located in any front yard setback may not exceed 4 feet above grade, except where the UDO authorizes the zoning administrator to permit a fence up to 10 feet above grade under the UDO’s stated findings.

Side and Rear Yard Height: In residential districts, fences or walls located in a side yard or rear yard may not exceed 8 feet above grade, except where the UDO authorizes the zoning administrator to permit a fence up to 12 feet above grade under the UDO’s stated findings.

Sight Distance Triangle Visibility Band: At street intersections subject to the City’s sight distance triangle standards, the code restricts obstructions to vision between a height of 2 feet and 10 feet above the specified street-elevation reference.

Sight Triangle Distances: The City’s sight triangle measurements are based on street right-of-way width, using 25 feet from the lot corner for streets with 50 feet or less right-of-way width and 40 feet from the lot corner for streets with more than 50 feet right-of-way width.

MATERIAL AND CONSTRUCTION LIMITS

Electric Fences: The UDO prohibits electric fences, except for livestock protection fences. The UDO states that invisible pet fences are not considered electric.

Retaining Walls: Where a fence or wall serves as a retaining wall, the UDO requires the retaining wall to be solid cement, masonry, or wood and constructed to the standards of the City of Gastonia.

Finished Side Orientation: The UDO requires the finished side of fences and walls to face the common property line boundary.

Other Materials: The municipal code does not specify a comprehensive list of permitted or prohibited fence materials for standard single-family residential fences beyond the items stated above.

PRIVATE RESTRICTIONS

Private restrictions, including HOA covenants and recorded deed restrictions, are not part of the municipal code and may be more restrictive than City of Gastonia requirements.

REVIEW AND ENFORCEMENT CONTEXT

Fence issues are typically reviewed during permit or approval review when required, and through complaint-based code enforcement. Examples include:

• Fence height compliance in front yard setbacks and in side or rear yards under the UDO’s residential district standards.

• Visibility obstructions within sight distance triangles at street intersections, including the 2-foot to 10-foot visibility band and the applicable corner measurement distances.

• Fences or related structures placed within a street right-of-way, where the City Code treats fences as potential encroachments.

• Fences within drainage or utility easements that block or materially impede stormwater runoff.

• Fence work within a local historic district that proceeds without the required Certificate of Appropriateness (COA).
